CAHNERS IN-STAT GROUP. All rights not expressly granted to You herein
are expressly reserved by CAHNERS IN-STAT GROUP. Any other use of the
Report by any person or entity is strictly prohibited and a violation
of this Agreement.
SCOPE OF RIGHTS LICENSED (PERMITTED USES)
CAHNERS IN-STAT GROUP is granting You a limited, non-exclusive, non-transferable
license to use the Report, in part or in whole, for Your internal business
or personal use. Any internal or personal use of the Report content must
be accompanied by the phrase "Used with permission from Cahners In-Stat
Group" or other phrasing agreed upon in writing by CAHNERS IN-STAT
GROUP.
RESTRICTIONS ON TRANSFER
Reproduction or disclosure in whole or in part to parties other than the
CAHNERS IN-STAT GROUP client which is the original subscriber to this
report is permitted only with the written and express consent of CAHNERS
IN-STAT GROUP. This report shall be treated at all times as a confidential
and proprietary document for internal use only.
Any purported sale, assignment, transfer or sublicense without the prior
written consent of CAHNERS IN-STAT GROUP will be void and will automatically
terminate the License granted hereunder.
LIMITED WARRANTY
THE INFORMATION CONTAINED IN THIS REPORT IS BELIEVED TO BE RELIABLE BUT
CANNOT BE GUARANTEED TO BE CORRECT OR COMPLETE. If the Report's electronic
delivery format is defective, CAHNERS IN-STAT GROUP will replace it at
no charge if CAHNERS IN-STAT GROUP is notified of the defective formatting
within ninety days from the date of the original download or receipt of
Report.
LIMITATION OF LIABILITY
IN NO EVENT WILL CAHNERS IN-STAT GROUP BE LIABLE TO YOU FOR ANY DAMAGES,
INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, LOST SAVINGS, OR OTHER
INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OR INABILITY
TO USE THE REPORT REGARDLESS OF WHETHER SUCH DAMAGES ARE FORESEEABLE OR
WHETHER SUCH DAMAGES ARE DEEMED TO RESULT FROM THE FAILURE OR INADEQUACY
OF ANY EXCLUSIVE OR OTHER REMEDY. IN ANY EVENT, THE LIABILITY OF CAHNERS
IN-STAT GROUP SHALL NOT EXCEED THE LICENSE FEE PAID BY YOU TO CAHNERS
IN-STAT GROUP.
